MEMORANDUM

                SUBJECT:          Complaint Investigation Report 

 

FY2007: Ten (10) complaints have been received to date. Of those, six (6) have been forwarded for legal review; two (2) remain under investigation; and two (2) await Board determination.

There are no pending cases from previous years.

For Board determination:

WWP-L1-2-2007-1            C alleged R is operating the water & wastewater facilities for the city without benefit of licensure. IBOL records do not contain information for R. INV revealed that R submitted a proposal to operate the city systems and a licensee was hired by the city to supervise R in the operation of the water & wastewater facilities. INV revealed that supervision was conducted over the phone, with little face to face contact. INV also revealed that R's advertising may be misleading. The file was sent to the DAG for review. Based on that review the R was sent a C & D letter informing R that such practice with out proper registration was unlawful and that future complaints would be forwarded to the appropriate Prosecuting Attorney. Based on that letter, IBOL recommends the Board authorize closure.

WWP-B6C-2-2007-7        R submitted CEU certificates for .3 CE credit. R was sent a letter requesting the additional .3 CEU's.  R did list another course on renewal form but did not provide documentation to support it. To date, according to IBOL records R did not respond to the request for additional CE documentation and has since let license expire. IBOL recommends the Board authorize closure.
