Meeting Minutes of August 4, 2003

Robert Payne called the meeting to order at
9:10 a.m.
MINUTES
Virginia Dickman moved to approve the April
7, 2003 board meeting minutes. Cheryl
Jurgens seconded and the motion carried.
Cheryl Jurgens moved to approve the June
30, 2003 conference call minutes. Vickie
Powers seconded and the motion carried.
LEGISLATION
Rayola Jacobsen updated the Board to the
new legislative changes that removes the option of pre-filing any legislative
changes. Any changes are to be
submitted on the first week of Legislation.
LAW CHANGE
The Board reviewed the law authorizing
fees, noting a lack of authority to charge an application fee.
The Board decided to draft language to correct this problem and submit it
for the 2004 Legislation.
CONTINUING EDUCATION
The Board discussed continuing education
for individuals that have had unusual circumstances and have not been able to
complete the continuing education requirement for renewal of their license.
Virginia Dickman moved to adopt language for a rule change, which will
give the Board authority to review the circumstance and make a decision based
upon the evidence provided by the licensee.
Cheryl Jurgens seconded and the motion carried.
FINANCIAL REPORT
Budd Hetrick presented the financial
report, which indicated a cash balance of $73,538.43.
The Board spent $37,617.60 over budget for 2003.
The investigative report indicated that no
complaints have been received for fiscal year 2004.
Sixteen are still under investigation or legal review for 2003.
Thirteen are still under investigation or legal review for 2002.
Four remain under investigation or legal review for 2001.
EXECUTIVE SESSION
Virginia Dickman moved to enter executive
session to discuss possible litigation not subject to public disclosure. Cheryl Jurgens seconded and the motion carried.
Virginia Dickman moved to enter regular
session. Cheryl Jurgens seconded
and the motion carried.
Cheryl Jurgens moved that complaint file
SWO-L3C-03-02-90 be sent back to the hearing officer to prepare findings of fact
and conclusion of order. Vickie
Powers seconded and the motion carried.
Virginia Dickman moved to dismiss case
number SWO-P4-02A-01-015. Vickie
Powers seconded and the motion carried.
Virginia Dickman moved that case number
SWO-S1-O2A-02-001 pay the maximum fine and pay all fees for the cost of the
investigation and take six hours of ethics.
Also to be sent a letter of reprimand.
Vickie Powers seconded the motion. Cheryl
Jurgens moved to amend the motion to suspend the license for six months.
No second. Ms. Jurgens moved
to amend the motion to suspend the license for three months.
No second. Ms. Jurgens moved
to amend the motion to suspend the license for two months.
No second. Ms. Jurgens moved
to amend the motion to suspend the license for one month.
Virginia Dickman seconded and the amended motion carried.
Cheryl Jurgens moved that a letter be sent
to Health and Welfare regarding hiring unlicensed social workers. Virginia Dickman seconded and the motion carried.
SOCIAL WORK APPLICANTS
The Social Work Board interviewed social
work applicant SWOA-24719 regarding a past conviction.
Virginia Dickman moved that applicant SWOA-24719 be approved to sit for
the examination. Vickie Powers
seconded and the motion carried.
Social Work applicant SWOA-16151 attended
the board regarding having failed the examination several times.
The Board will check with ASWB for any help or suggestions they can give.
Social Work applicant SWOA-24964 made
application for endorsement for the masters level license.
The applicant had passed the ASWB clinical level examination in another
state, but held a masters level license. The
Social Work Rules state that the intermediate level examination must be taken
for the masters level license. The
Board indicated that they would check with ASWB on the differences of
requirements for the different levels of examinations.
ASWB SPRING MEETING
Virginia Dickman reported on the spring
ASWB meeting at Buffalo New York. The
meeting was not well attended, but the content was very good.
The next meeting is in November.
RULES
The Board reviewed the draft copy of the
proposed rules and made additional changes.
Virginia Dickman moved that the proposed temporary rules go into effect
on August 15, 2003. Cheryl Jurgens
seconded and the motion carried.
The Board meeting adjourned at 4:30 p.m.
