Minutes of June 21, 2005

The Idaho State Licensing Board Of Professional Counselors and Marriage & Family Therapists meeting was called to order at 10:07 a.m., Tuesday, June 21, 2005, at the Bureau of Occupational Licenses, Owyhee Plaza, 1109 Main Street, Suite 220, Boise, Idaho.

 Formal Disciplinary Action 

Let it be known that Roberta Crockett and Eric F. Jones have recused themselves from discussion and voting privileges regarding Case No. COU-2004-1 in the license matter of Gail Ater. 

COU-2004-1:  Moved by Jerry Fischer that Mr. Ater‘s course of action, in following his client out of his office and into the hallway and verbally confronting the client who was in an agitated state, was not in the best interest of the client but was pursued for Mr. Ater’s personal needs.  Respondent actions have violated the ACA Code, sections A.1.a and A.5.a.   Seconded by Brenda Freeman, motion carried. 

Moved by Jerry Fischer that Mr. Ater’s license should be suspended for one year with the entire year stayed upon condition that Mr. Ater practice under supervision of an approved supervisor.  Mr. Ater must also pay a $2,000 fine and the cost and attorney fees incurred in the investigation.  Seconded by Jun Shiosaki, motion carried. 

Moved by Jun Shiosaki to have Attorney Hales draft the Final Order for the Board’s signature.  Seconded by Jerry Fischer, motion carried. 

Moved by Jun Shiosaki that the meeting be adjourned.  The time being 10:46 a.m.  Seconded by Brenda Freeman and carried.
