Meeting minutes of May 3 &4, 2005

Chairman Dr. Birdsall
opened the meeting at 9:00a.m. to hear oral arguments in case COU-2004-1
Roberta Crockett and Dr. Jones recused themselves from the case.
Dr. Fischer moved to go into executive session to consider and advise its legal representatives in pending litigation or where there is a general public awareness of probable litigation. Dr. Freeman seconded the motion, and it carried.
Mr. Shiosaki moved
to come out of executive session. Dr.
Fischer seconded, and the motion carried.
The Board will review the
information and meet in the future by conference call to make a decision.
Chairman Birdsall resumed
the chair and called the meeting to order at 9:45a.m.
Dr. Fischer moved to
approve the minutes of February 1-2, 2005 as amended.
Mr. Shiosaki seconded the motion, and it carried.
Dr. Freeman moved to
approve the minutes of February 8, 2005 conference call
Dr. Fischer seconded the motion and it carried.
BUREAU STAFF
Mr. Hetrick reported that the law changes will take effect on July
1, 2005. Three new Boards will be
added to the Bureau (Contractors, Naturopaths and Petroleum Dealers) and one
existing Board expanded (Audiologists and Speech-Language Pathologists added to
the Hearing Aid Dealers and Fitters Board). This
will involve hiring new staff and remodeling the office to accommodate the
staff. Indirect
costs to Boards will be spread out more and will impact all Boards within the
Bureau.
A letter from Idaho
Mental Health Counselors Association was read.
The letter states that the structure of the Board is wrong and needs to
be fixed by the Board. An
explanation of the process was made which included that nominations are sent
into the Governor’s office and the Governor chooses the person or persons to
fill the Board position. Mr.
Shiosaki stated that it takes time and commitment to serve on the Board and many
people do not want to invest the time and loss of wages a Board position takes.
The primary work of the Board is to protect the public and Board members
are not to be advocates of their profession.
The Board goes on record
to say that the Idaho Counseling Association and the Idaho Mental Health
Counseling Association work together on nominations to the Board.
Mr. Stringfield presented
recommendations for a stipulated agreement and consent order for case COU-2004-5.
Dr. Fischer moved to accept the recommendations for the stipulated
agreement and consent order. Ms.
Crockett seconded the motion and it carried.
Dr. Fischer moved to
amend the consent order to include six
months of supervision by a Board approved supervisor.
The supervision would include developing or verifying studies in
confidentiality, informed consent procedures and HIPPA policies and procedures.
Ms. Crockett seconded the amendment and it carried.
Mr. Stringfield presented
recommendations for case COU 2005-03. Mr.
Shiosaki moved to accept the recommendations.
Dr. Jones seconded the motion and it carried.
Mr. Shiosaki moved to
take a lunch break at 11:45a.m. Dr.
Fischer seconded the motion, and it carried.
Chairman Birdsall called
the meeting to order at 1:03p.m. with all Board members present.
Budd Hetrick, Roger Hales and Janice Wiedrick were also present.
Mr. Hetrick presented the financial report showing a positive balance of $76,869.33.
Mr. Shiosaki moved to
approve the financial report. Ms.
Crockett seconded the motion, and it carried.
Mr. Hetrick presented the
investigative report showing that for the year 2005, 23 complaints have been
received. Three have been closed, and one is waiting formal action.
For 2004, two are waiting Board action and for 2003 one is waiting for
formal action.
Mr. Hetrick presented recommendations for the following cases.

Dr. Fischer moved to accept the recommendations of the Bureau to flag the
file and close the case. Dr. Freeman seconded the motion, and the motion
carried.
COU-P1-3-03-7
Dr. Fischer moved to accept the recommendations of the Bureau to flag the
file and close the case. Dr. Jones
seconded the motion, and it carried.
COU-L2B-2-04-01
Dr. Fischer moved to accept the recommendations of the Bureau to close
the case. Dr. Freeman seconded the
motion, and it carried.
COU-S6A-3-04-3
Ms. Crockett moved to accept the recommendations of the Bureau to close
the file. Mr. Shiosaki seconded the
motion, and it carried.
COU-P3B-1-05-11
Dr. Jones moved to accept the recommendations of the Bureau to close the
file. Dr. Fischer seconded the
motion, and it carried.
Discussion was held on
the use of the word “Counselor” that was recently in the media, and the
Associations are more appropriate to advocate the use of the word and to help
with wording and definitions.
Mr. Hetrick explained the
complaint process to the Board and guests.
Mary Barros Bailey met
with the Board on media counseling and media supervision.
Dr. Fischer moved to go
into executive session to consider records that are exempt from disclosure as
provided in chapter 3, title9, Idaho Code. Dr. Freeman seconded the motion, and
it carried.
Dr. Fischer moved to come
out of executive session. Mr.
Shiosaki seconded the motion, and it carried.
NEW BUSINESS
Discussion was held on
Out-of-State Supervisors. Out-of-state supervisors do not have to meet the
requirements for Idaho Supervision; but must meet their home state’s
requirements for supervision.
Dr. Fischer moved to
change rule 200.03.b. from three supervisees per supervisor to no more than six
supervisees per supervisor. Dr.
Freeman seconded the motion, and it carried.
The July meeting date has
been set for July 19 and if necessary July 20, 2005.
Dr. Fischer moved to
amend rule 149 to require that completed applications be submitted at least
seven (7) days prior to the next meeting. All
others will be held until the next scheduled meeting. Ms. Crockett seconded the
motion, and it carried.
Dr. Jones moved to go
into executive session to consider records that are exempt from disclosure as
provided in chapter 3, title 9, Idaho Code. Ms. Crockett seconded the motion,
and it carried.
Mr. Shiosaki moved to
come out of executive session. Dr.
Fischer seconded the motion and it carried.

adjourn the meeting at 4:20p.m. Mr.
Shiosaki seconded the motion, and it carried.
May 4, 2005
Chairman Birdsall called
the meeting to order at 9:06a.m. All
Board members were present and Guests included Piper Field, President of Idaho
Marriage and Family Therapy Association; Todd Frye, President of Idaho
Counseling Association; Pat Alexander, President of Idaho Mental Health
Counseling Association; and Ervin Booth, AASCB National Credential Committee.
Bureau Staff included Budd Hetrick, Roger Hales, and Janice Wiedrick.
Mr. Booth spoke on
portability of licenses and the Registry that is to give licensees a format for
portability. The American Association of State Counseling Boards (AASCB)
is in negotiations with the National Board for Certified Counselors.
This would be a stabilized holding place for candidate information with
no costs to Boards. There are two
tiers of licensure: tier one requires a 48 semester hour degree and tier two
requires a 60 semester hour degree. Both
require supervised experience and tier two does allow for equivalencies.
Law and Rule changes
would be required in Idaho to adopt the Registry.
The Associations will be asked for feedback on this.
The Board would like time at the January Idaho Counselor Association
Convention for discussion on this.
Discussion was held on
Service Extenders for Counselors.
Mary Barros Bailey
presented the Board with information on the National Board for Certified
Counselor (NBCC) requirements. NBCC
is the first to take up media counseling and is working on a second revision for
technology assisted counseling. Crossing
state lines has not been addressed. Confidentiality is the most important aspect
and this has not been fully
addressed at this time. Consumers
must be informed of the potential problems with confidentiality.
HIPPA is another problem with record keeping.
For HIPPA the records must be maintained for six years.
Disclosure statements must be signed and kept.
E-mails can be encrypted but this has expenses involved.
Informed consents are available on-line but transference of information
is difficult because someone could break in. Technical failure will have
protocols in place. Insurance
billing will be available. Confidentiality
and verification of clients and counselors become part of the informed consent
for media counseling.
Mr. Hetrick stated that
issue may require clarification in rules.
The meeting recessed for

Wiedrick present.
A subcommittee of Dr.
Fischer and Dr. Freeman was formed to work on the informed consent for media
based counseling. This will include an adequate time frame, information to the
Board before the meeting and where other states are in adopting media based
counseling.
Dr. Jones moved to go
into executive session to consider records that are exempt from disclosure as
provided in chapter 3, title 9, Idaho Code. Dr. Fischer seconded the motion, and
it carried.
Dr. Freeman moved to come
out of executive session. Dr.
Fischer seconded the motion, and it carried.
Dr. Jones and Ms.
Crockett’s terms of office are up in July.
Letters from the Bureau are to be sent to the Governor’s office and
Associations. Mr. Shiosaki’s appointment is also up in July and he has
sent a letter to the Governor.
Rayola Jacobsen reported
on the Legislative session and the Bureau is gaining new Boards and expanding
one Board. This will require more staff and remodeling the office to
make more space for staff.
Dr. Jones moved the Board
is to pay the lunch expenses for Jun Shiosaki and Ervin Booth. Dr. Fischer
seconded the motion, and it carried.
Ms. Crockett moved to go
into executive session to consider records that are exempt from disclosure as
provided in chapter 3, title 9, Idaho Code.
Dr. Jones seconded the motion, and it carried.
Mr. Shiosaki moved to
come out of executive session. Dr.
Fischer seconded the motion, and it carried.
Dr. Fischer moved to
issue licenses to those applicants approved by the Board and send letters to
those not approved. Ms. Crockett
seconded the motion, and it carried.
The Board thanked Mr.
Shiosaki for his service to the Counseling profession and noted that his service
will be missed.
Mr. Shiosaki moved to
adjourn the meeting at 4:45p.m. Dr.
Fischer seconded the motion, and it carried.
