Chairman Jones called the meeting to order at 9:08a.m.
Dr. Fischer moved to approve the minutes of May 4 & 5, 2004. Dr. Birdsall seconded the motion and it carried.
Ms. Jacobsen reported that the Board may wish to consider a fee increase based upon the Board going $21,404 over budget for 2004. A fee increase would involve a Law change for this year and a Rule change next year.
Ms. Jacobsen reported on the new law regarding conference calls. A Board member is no longer required to be in the office during a conference call. The Bureau Chief, however, must be physically present at the location designated in the meeting notice to ensure that the public may attend such meeting in person.
Ms. Guyon presented the disciplinary report regarding case COU-2004-5. The Board recommended a one-year probation with $1,000 fine and costs; supervision for one year at the ratio of 1-30 hours of direct, client contact by a supervisor approved by the Board. The supervisor is to report quarterly on the progress and the supervisor is to make sure that all documents of the MMPI traineeship are on file.
Mr. Hales presented the proposed Law changes to the Board. Dr. Fischer moved to approve the changes made to the proposed Law and for the Bureau to proceed with the presentation to Legislators. Mr. Shiosaki seconded the motion and it carried.
Rules were discussed and the following were noted:
1. Simplifying the Application
2. Deleting Pastoral Counselor language
3. Adding exam requirements for the National Clinical Mental Health Counselor
Exam.
4. Add an endorsement fee of $75.
The Bureau is to add the NCMHCE to the examination intent to sit form.
Dr. Birdsall moved to have postcards sent to LCPCs, LCPCs and LMFTs about the NCMHCE exam being required for LCPC licensure. Also on postcard about the one hour of Ethics that will be required per year. Dr. Fischer seconded the motion and it carried.
Dr. Jones is to write a letter to the Associations and the Universities about the new exam and the one-hour of ethics requirement.
Dr. Fischer moved to approve the rule changes. Dr. Birdsall seconded the motion and it carried.
Ms. Crockett moved to have the Bureau add a color insert to the Renewal Notices on the CEU change. Dr. Birdsall seconded the motion and it carried.
PORTABILITY
Discussion was held on Portability of licenses.
1. The Endorsement Rules should be modified if portability is approved.
2. NBCC would hold the credentials and would establish the national standards.
3. The Marriage and Family Therapists do not have portability at this time.
4. Increase the requirement for supervised experience to 2,000 hours for LPCS.
5. Obtain feedback from the Associations.
Dr. Birdsall moved to invite AASCB Portability Committee to a meeting after the AASCB meeting to a Board meeting for further discussion. Ms. Crockett seconded the motion and it carried.
Mr. Shiosaki moved to break for lunch and reconvene at 1:00p.m. Dr. Fischer seconded the motion and it carried.
Chairman Jones reconvened the meeting at 1:10p.m.with all Board members except Dr. Freeman in attendance.
Discussion was held on the Chairman recognizing a guest before the guest can make comments.
Dr. Birdsall moved to ensure that the word Professional is used in all references to counselors or clinical counselors in the proposed rules. Mr. Shiosaki seconded the motion and it carried.
Dr. Birdsall invited the Board and Bureau Staff to dinner at 6:30p.m.
The Board is invited to the Idaho Marriage and Family Therapy Convention on October 1, 2004 at Boise State University.
The Idaho Counselor Association Convention is on January 21-23, 2005 in Coeur dAlene.
Dr. Fischer moved to pay the renewal of the AASCB fees. Mr. Shiosaki seconded the motion and it carried.
Discussion was held on rural applicants having difficulty finding an approved Supervisor. The Board determined that electronic, on-line supervision would be acceptable if both parties use a web-cam.
October 5-6, 2004 meeting agenda items:
1. Language to be added to rules on one-to-one, face-to-face, web-site supervision using web-cams.
Dr. Fischer moved to go into executive session to consider application records that are exempt from disclosure as provided in Chapter 3, Title 9, Idaho Code. Dr. Birdsall seconded the motion and it carried.
Dr. Birdsall moved to come out of executive session and recess for the day. Mr. Shiosaki seconded the motion and it carried.
July 30, 2004
Chairman Jones called the meeting to order at 9:05a.m. Board members present: Dr. Freeman, Mr. Shiosaki, Dr. Fischer, Dr. Birdsall and Ms. Crockett. Bureau Staff present: Ms. Jacobsen and Mr. Hetrick.
Dr. Birdsall was thanked for the dinner and Dr. Freeman was welcomed to the Board.
INVESTIGATIVE REPORT
For 2005: three investigations to date.
For 2004: twenty-six complaints received. Fifteen are open and under investigation; four have been closed without action; two referred for disciplinary action; and five await Board determination.
For 2003: twenty-one complaints were received. Ten remain under investigation; five have been closed without action; three were referred for disciplinary action; and three await Board determination.
For 2002: fourteen complaints were received. Two remain under investigation; eight have been closed without action; and four were referred for disciplinary action.
For 2001: three complaints were received. One was closed without action; two were referred for disciplinary action.
There are four scheduled hearings.
COU-L3B-02-04-7 Ms. Crockett moved, given the evidence, to accept the Bureaus recommendation to close the case. Mr. Shiosaki seconded the motion and it carried.
COU-P1-1-04-17 Mr. Shiosaki moved to send a letter to advise the licensee about the license renewal process. Dr. Fischer seconded the motion and it carried.
COU-P1-1-04-18 Dr. Fischer moved to accept the Bureaus recommendation to close the case. Ms. Crockett seconded the motion and it carried.
COU-P1-1-04-19 Dr. Birdsall moved to close the complaint file without action. Dr. Freeman seconded the motion and it carried.
COU-P4C-1-04-21 Ms. Crockett moved to close without action. Mr. Shiosaki seconded the motion and it carried.
COU-S3-2-03-6 Dr. Fischer moved to close with an advisory letter to the counselor about the responsibilities of a counselor and to the person practicing without a license. Dr. Birdsall seconded the motion and it carried.
COU-L2A-3-03-11 Dr. Birdsall moved to close without action. Dr. Fischer seconded the motion and it carried.
COU-L2A-3-03-12 Dr. Birdsall moved to close without action. Dr. Fischer seconded the motion and it carried.
For the stipulated reprimand and final order COU-2003-3 Dr. Birdsall moved to accept the changes and authorize Chairman Jones to sign the order. Ms. Crockett seconded the motion and it carried.
ELECTION OF OFFICERS
Mr. Shiosaki nominated Dr. Birdsall as Chairman starting immediately. Dr. Fischer seconded the motion and it carried.
Mr. Shiosaki nominated Ms. Crockett as Vice-Chairman. Dr. Freeman seconded the motion and it carried.
The Board expressed their appreciation to Dr. Jones for his work and leadership as Chairman.

Dr. Jones moved to come out of executive session. Ms. Crockett seconded the motion and it carried.
Recessed for LunchChairman Birdsall reconvened the meeting at 1:00p.m. with all members present except for Dr. Freeman.

Dr. Fischer moved to adjourn the meeting at 2:20p.m. Mr. Shiosaki seconded the motion and it carried.
