Idaho State Counselors Licensing Board
Minutes of July 12-13, 2000
The regular meeting of the Idaho Counselor Licensing Board was called to order at 9:10a.m. by Chairman Richard Craig. Board members present were: Richard Craig, Chairman; Dawna Jackson and Jun Shiosaki.
Also present are: Thomas E. Limbaugh, Bureau Chief; Budd Hetrick, Deputy Bureau Chief; Kirsten Wallace, Prosecuting Attorney; Roger Hales, Administrative Attorney; Donetta Foss, Continuing Education Secretary; Janice Wiedrick, Secretary, Bureau of Occupational Licenses.
Dawna Jackson moved to approve the minutes of the May 5-6, 2000 meeting as corrected. Jun Shiosaki seconded the motion, motion carried.
REVIEW OF FILES:
The following files were approved for Licensed Professional Counselor license upon receipt of the $75 original license fee:

LICENSED PROFESSIONAL COUNSELOR-PRIVATE PRACTICE
The following files were approved for the Licensed Professional Counselor-Private Practice license based upon receipt of the $20 original license fee:
COU 063000 DBZ, COU 063000 ST, COU 012600 MCB, COU 070500 KLG, COU 070700 SDJ, COU 052500 DPM, COU 979599 RER, COU 052600 DRT.
The following files were not approved for the noted reasons:
COU 061200 TWD – needs verification of 238 hours
COU 052200 RWJ – proof of 1,800 hours prior to 1-1-98 and 200 supervised hours after
COU 971100 TLM – needs supervision pages
COU 100698 GRR – clarification from supervisor
Dawna Jackson moved to go into executive session to discuss potential litigation and documents otherwise exempt from the public record. Jun Shiosaki seconded the motion, motion carried.
Jun Shiosaki moved to come out of executive session, Dawna Jackson seconded the motion, motion carried.
Jun Shiosaki moved to deny the Licensed Professional Counselor-Private Practice license to applicant COU 040500 MF. A letter will be sent to the applicant advising that the 2,000 hours of supervision must be after the Licensed Professional Counselor license has been issued. Dawna Jackson seconded the motion, motion carried.
CONDITIONAL PROFESSIONAL COUNSELOR
The following files were approved for the Conditional Professional Counselor license:
COU 062300 DG and COU 060900 CHH
CONTINUING EDUCATION
Donetta Foss met with the Board to discuss requests from licensees that excess continuing education credits be carried over to the following year.
Donetta noted that tracking excess CE units could be accomplished. Licensees wishing to carry over excess CE would have to submit documentation and a letter noting the number of hours to be carried over.
Dawna Jackson moved to allow five (5) hours per year to be carried over to the next year. Jun Shiosaki seconded the motion, motion passed.
A letter to be sent to all LPCP’s explaining how to do the carryover.
The meeting recessed at 4:00p.m. to reconvene on July 13, 2000 at 9:00a.m.
JULY 13, 2000
The meeting reconvened at 9:10a.m. with all Board members and Bureau Staff in attendance.
Tom Limbaugh presented the financial report to the Board. The report shows a positive balance of $101,548.01.
Authorizing payments for the Pro-review of complaints was discussed. A budget request for such payments will have to be submitted with the Bureau budget and approved by JAFAC to allow the expenditure.
The proposed draft legislation for the Marriage Family Therapist addition to the Counselor law was presented to the Board.
AASCB meeting will be held in Tampa, Florida on the second weekend of January 2001.
Tom Limbaugh is invited to the convention.
Roger Hales met with the Board to discuss the proposed law and rule changes.
Add definition for ‘Good Moral Character" as a lack of honesty or the conviction of any felony.
Roger will research the Buckley Amendment, referenced on the license application.
Discussion was held on 54-3402 to delete the words "or sect or faith-based counseling of any kind." If proposed, this change should be an independent bill.
Discussion was held concerning "Counselor Intern." A law change is necessary to create an exemption for Counselor Intern under the supervision by an LPC. Once the law passes, a conference call would be held to adopt temporary rules.
A Model Disclosure Statement will be faxed to the Board once the changes have been completed.
Kirsten Wallace met with the Board to discuss a law change for 54-3407. She recommended adding the words "or other discipline" after the words "revoke or suspend."
Dawna Jackson moved to accept the proposed law changes. Jun Shiosaki seconded the motion, motion carried.
RULE CHANGES
The Board moved by consensus to change the examination fee rule from $50 to "The fee charged to the Bureau by the National Board for Certified Counselors."
Budd Hetrick met with the Board to discuss fee rules and present Board policy. The Board confirmed that all licensure fees should be supported by law and rule. Dawna Jackson moved to submit a rule change for the original license fee for Licensed Professional Counselor-Private Practice from $20.00 to $75.00. Jun Shiosaki seconded the motion, motion carried.
Jun Shiosaki moved to go into executive session for discussion of complaints. Dawna Jackson seconded the motion, motion carried.

Concerning complaint COU-P4C-04-99-003, Dawna Jackson moved that a proposed consent agreement be drafted to include: a six (6) month suspension that would be stayed; a five (5) year probation; a fine of $500 and $250 cost recovery fee; and completion of four (4) hours of ethics coursework within 6 months. Jun Shiosaki seconded the motion, motion carried.
For complaints COU-P1-04-00-005 and COU-B1-02A-99-006, the Board adopted the recommendations provided by Kirsten Wallace.
BOARD BUSINESS FILE
Jack Newsome, Ph.D., asked for clarification of the required counseling coursework.
The Board requested that a letter be sent stating that if the programs were not included in the course syllabuses of Idaho Universities, the catalog descriptions would be necessary before a decision could be reached. Acceptable courses must fall within the eight specified areas of Counseling, and the Counseling Department at ISU may be contacted for assistance in this matter.
