Meeting was called to order at 8:40 a.m.
Board Members present: Jerry Nemec-Chair; Steve R. Pinther, Art Elliott, Alan Gelet and Pamela Prather.
Others present: Rayola Jacobsen-Bureau Chief, Budd Hetrick Jr- Deputy Bureau Chief; Roger Hales- Administrative Attorney, Cherie Simpson- Management Assistant and Alla Osipchuk- TRSI.
The Board discussed a possible law change to allow honorarium payment for board members.
Mr. Hetrick presented the financial report and investigative report.
The Board discussed the costs of anticipated investigations. Mr. Hetrick estimated 70-100 anticipated investigations per year.
DISCIPLINARY ACTIONS:
Motion was made by Mr. Elliott to approve Bureau recommendations regarding CON-P4A-2-2006-3. Seconded by Ms. Prather. Motion carried.
Motion was made by Mr. Gelet to approve Bureau recommendations regarding CON P4A-2-2006-8. Seconded by Ms. Prather. Motion carried.
Motion was made by Ms. Prather to approve Bureau recommendations regarding CON-P1-2-2006-10. Seconded by Mr. Elliott. Motion carried.
Motion was made by Mr. Elliott to approve Bureau recommendations regarding CON-PI-4-2006-16. Seconded by Ms. Prather. Motion carried.
The Board discussed wall certificates, samples were presented. Costs for doing the wall certificates were discussed.
Mr. Pinther joined the meeting at 9:35 am. Board signed sheets to be scanned for wall certificates. The wall certificate lay out was changed to display a current registration card.
Motion was made by Ms. Prather to approve wall certificates. Seconded by Mr. Elliott. Motion carried.
Mr. Hales presented a letter requesting a review for temporary contractor worker agencies.
Motion was made by Ms. Prather to enter into executive session. Seconded by Mr. Elliott. Motion carried.
Motion was made by Mr. Elliott to come out of executive session. Seconded by Ms. Prather. Motion carried.
Motion was made by Mr. Gelet to approve 94 applications on CD and 65 applications completed prior to meeting. Seconded by Mr. Elliott. Motion carried.
The board discussed the revision to the application form. Recommended changes were noted. Mr. Hetrick reviewed list of contractor types. Mr. Elliott recommended that the list should match the order of the construction process. Recommended changes were noted.
The Board discussed the renewal process on line and the verification of insurance validity.
Mr. Hetrick recommended auditing 10% of on line renewals for insurance compliance.
Mr. Hales recommends that according to 54-5211 and 54-5210(e), renewal does not require submission of actual certificates of insurance.
The board discussed the possibilities of a signed affidavit on the renewal process for insurance verification. It was determined that renewals can by done on line with auditing of 10 %.
The Board asked that registration display requirements found in 54-5212(2) be sent out with renewal notices explaining the full extent of advertising to include lettering on company trucks.
The Board asked to see insurance expiration date instead of effective date. Mr. Hales will check to see if changes are possible.
The Board requested a monthly e-mail on the status of the renewal process.
The Board requested that Jeremy Pisca be invited to the next meeting.
The Board discussed Draftsman and Designer being exempt under the law. It was determined that draftsman and designers that act within their scope of practice and do not participate in the contractor/construction aspect in their practice are exempt under 54-5205, Idaho Code.
Mr. Elliott addressed contractor and suppliers lien rights. It was determined that this issue would be discussed with Jeremy Pisca during the next meeting.
Mr. Hales left the meeting at 12:15 pm
The Board discussed the revisions to the application. Mr. Hetrick will make necessary changes to application.
Motion was made by Mr. Elliott to approve the application changes. Seconded by Mr. Gelet. Motion carried.
Motion to adjourn was made by Mr. Gelet. Seconded by Ms. Prather. Motion carried. Meeting adjourned at: 12:15p.m.
