Meeting was called to order at 10:05 a.m. by Jerry Nemec, Chair.
Board Members present: Jerry Nemec-Chair; Pam Prather, Steve R. Pinther, Art Elliott, and Alan Gelet.
Others present: Tana Cory, Bureau Chief; Budd Hetrick, Deputy Bureau Chief; Mike Gilmore, Senior Deputy Attorney General; Cherie Simpson- Management Assistant; and Erin Anderson-TRS1.
Minutes of 4/17/07 were reviewed. It was pointed out that Mr. Elliott was not in attendance at meeting on 4/17/07. Board approved minutes with the removal of Mr. Elliott from the notes. Moved by Ms. Prather to approve the minutes as presented. Seconded by Mr. Pinther, carried.
Mr. Gilmore addressed the following memorandums with the Board:
2007-66- Mr. Gilmore presented this memorandum to the Board and received direction. Mr. Gilmore will pursue.
2007-76, 2007-77, 2007-78- Mr. Gilmore presented consent orders. The Board approved the orders. Mr. Gilmore will pursue.
Mr. Pinther mentioned State of Rhode Island’s contractor’s website, wondering if we should see how they handle their state’s discipline matters. Mr. Gilmore pointed out that we would have to follow our State statutes.
The Board discussed attorney fees with Mr. Gilmore. Mr. Gilmore stated that the Attorney General bills $250.00 per case. Mr. Gilmore then stated that at the next scheduled meeting he will be discussing stipulation orders and attorney fees for those cases.
Motion was made by Mr. Pinther to enter into executive session to discuss applications and matters not subject to public disclosure, per section 9-340 C, Idaho code. Motion was seconded by Mr. Elliott, carried.
Motion was made by Mr. Elliott to come out of executive session. Motion was seconded by Ms. Prather, carried.
Motion was made by Mr. Elliott to approve all reviewed applications. Motion was seconded by Mr. Pinther, carried.
Mr. Elliott said that he had received a letter from the Industrial Commission in regards to the requirements of disclosure for the contractor’s registration number. Board discussed matter, and asked secretary to contact Frankie with the BCA to obtain a media list, so that a letter explaining disclosure requirements could be mailed out. They asked for a rough draft of this letter to be presented at 5-29-07 board meeting.
Ms. Prather then addressed felony application questions, and expressed that she would like more information with the application for registration. It was then decided by the Board to discuss at its next scheduled meeting possible changes to the application with regard to more specific information on the felony issue.
Motion was made to adjourn meeting by Mr. Elliott. Motion was seconded by Mr. Pinther, carried.
Meeting was then adjourned at 11:25.
