Meeting was called to order at 8:30 a.m. by Jerry Nemec, Chair.

Board Members present:  Jerry Nemec-Chair; Pam Prather, Steve R. Pinther, Art Elliott, and Alan Gelet.

Others present: Tana Corey, Bureau Chief; Roger Hales, Administrative Attorney; Budd Hetrick, Deputy Bureau Chief; Cherie Simpson- Management Assistant, and Erin Anderson-TRS1.

Minutes of 2/13/07 and 2/27/07 were reviewed.  Moved by Ms. Prather to approve the minutes as presented.  Seconded by Mr. Pinther, carried.

Ms. Cory discussed staff updates with the board.  The Bureau will be adding 2 Office Specialist I positions, and 2 Investigative Unit members.  Ms. Cory presented the financial report to the board, with Mr. Hetrick breaking the expenditures of the board down for their review.

Discussion was held on the reprint of existing contractor literature “How Does Idaho’s Contractor Registration Law Affect You?”.  Moved by Ms. Prather to approve with a correction to the fax number and the addition of the disclosure statement to the brochure, Seconded by Mr. Gelet, carried. 

Discussion was held on the new contractor literature “Consumers Guide to Hiring a Contractor”.  Mr. Pinther stated that he felt the services that the Bureau offered to the public should be advertised more in the brochure.  Mr. Elliott suggested that different photos be put on the flyers that were more related to the contracting field.  All board members were in agreement that certain sections of the flyer could be deleted and condensed.  They also agreed to adding the disclosure statement to this new flyer.  The new flyer was then tabled for review at the 4-3-07 board meeting with the changes.

The Board expressed their concerns with the website to Ms. Cory.  They feel that it is not user-friendly to the public and recommended something similar to Rhode Island’s website.   Tana made note of some of the requested changes to make.

Meeting dates were scheduled.  Following are the next few meetings:  conference call meetings to be held 4-3-07, 4-17-07, 5-8-07, and 5-22-07 and 6-12-07 scheduled for a regular board meeting.  Board also asked that at the 6-12-07 meeting that Jeremy Pisca and Roger Hales should be asked to attend, to discuss House Bill 101.

Motion was made by Ms. Prather to enter into executive session to discuss applications and matters not subject to public disclosure.  Motion was seconded by Mr. Pinther, carried.

Motion was made by Mr. Elliott to come out of executive session.  Motion was seconded by Mr. Gelet, carried.

Applications were approved with the following still pending:  Applicant number 900057371.  The board requested additional information from registrant in regards to evidence of restitution payment.   Motion was made by Mr. Elliott to approve application for Rhett Wright pending receipt of current insurance information.  Seconded by Mr. Pinther, motion carried.

The Board addressed the need to mail out letters to the agencies that issue building permits, reiterating with these agencies that a contractor must have a registration number, and if they do not, the permit must reflect that the contractor is not registered.  The members of the Board feel that there was confusion within these agencies and the city and county laws in relation to our contractor registration rules and laws.  Board would like to review the letter before it is sent out.

Mr. Hetrick presented the investigation report.  This was the following information provided to the board:

FY2007: To date, four hundred -thirty-three (433) complaints have been received. Of those, one hundred-ten (110) have been closed following Board determination; one hundred nine (109) have been referred for disciplinary review; one hundred sixty-three (163) are under investigation; and fifty-one (51) await Board determination.

FY2006: Fifty-six (56) complaints were received. Of those, twenty-two (22) have been closed following Board determination; fourteen (14) have been referred for disciplinary review; twelve (12) remain under investigation; and eight (8) await Board determination.

CON-P1-2-2006-2 IBOL recommends the Board authorize closure.  Recommendation was moved for approval by Ms. Prather, seconded by Mr. Gelet, carried.

CON-P4A-2-06-17 IBOL recommends the Board authorize closure with advisory letter that both parties work to resolve the matter.  Recommendation was moved for approval by Ms. Prather, seconded by Mr. Gelet, carried.

CON-P4-2-06-20 The DAG reviewed and sent R a warning letter advising of the disclosure requirements. Based on the notice sent from the DAG to R the Bureau recommends closure.  Recommendation was moved for approval by Ms. Prather, seconded by Mr. Gelet, carried.

CON-P4A-2-06-28 IBOL recommends the Board authorize closure with an advisory letter to R regarding timely service, and a letter to C recommending legal advice for other possible means of resolution.  Recommendation was moved for approval by Ms. Prather, seconded by Mr. Gelet, carried.

CON-P4C-4-06-41 IBOL recommends the Board authorize closure.  Recommendation was moved for approval by Mr. Gelet, seconded by Ms. Prather, carried.

CON-P1-1-2006-45 IBOL recommends the Board authorize closure.  Recommendation was moved for approval by Ms. Prather, seconded by Mr. Gelet, carried.

CON-P1-1-2006-46 IBOL recommends the Board authorize closure.  Recommendation was moved for approval by Ms. Prather, seconded by Mr. Gelet, carried.

CON-P1-1-2006-49 Due to lack of jurisdiction, IBOL recommends the Board authorize closure with an advisory to R of the registration requirement.   Recommendation was moved for approval by Mr. Gelet, seconded by Ms. Prather, carried.
